1 · Agreement

A note on words. In these terms, "the app" means the Climaweather mobile application; "the site" means climaweather.com; "the service" means both together; and "you" means the person using either.

These terms are an agreement between you and Yellowstone Global Partners Ltd, a company registered in England and Wales under number 17210635, registered office 44 Hartford Avenue, Harrow, Middlesex, HA3 8SY, United Kingdom, trading as Climaweather ("we", "us", "our"), about your use of the Climaweather app and website.

On the website, sections 3, 6, 7, 9 and 13 apply to your use of the site: the forecast disclaimer, our intellectual property, third-party content, our responsibility to you, and governing law. Nothing else on this page binds a site visitor who has not used the app.

These terms sit alongside the app store's own terms. Where these terms and the store's terms cover the same thing, the store's terms take precedence for the software licence itself.

In the app, you accept these terms by continuing past the first screen, which tells you so and links to this page.

The Privacy Policy explains what we do with your information. It is a notice, not a contract term; it does not form part of this agreement, and accepting these terms is not consent to any processing that needs your consent separately.

2 · The service

Climaweather is a free personalised weather app. It takes forecast data from professional providers, applies your answers about your routine and comfort, and presents what matters to your day.

There is no account. You do not give us a name, an email address or a password. Your device is identified by a random token created when you first open the app.

We may add, change or withdraw features where that is needed to keep the service safe, lawful, technically current or affordable to run as a free app, or to improve how it works. Where a change materially reduces what the app does, we will tell you in the app first.

3 · Forecasts are estimates, not promises

This is the most important section on this page.

Weather forecasts are predictions, not facts. They are produced from data supplied by third-party meteorological providers, they can be wrong, sometimes badly, and the further ahead they look the less certain they are.

But you must never rely on Climaweather alone for any decision where the weather could put you or anyone else at risk. That includes, and is not limited to: sailing, boating or any activity on or near water · hiking, climbing or being in the mountains · flying · driving in severe conditions · working outdoors in extreme heat or cold · any decision about someone's health or safety.

For those decisions, use an official source. In the UK that means the Met Office, and for anything at sea the Maritime and Coastguard Agency. Follow any official warning even when our app shows something different.

Climaweather presents forecasts honestly. Where an hour or a day is missing from the data, the app shows it as missing rather than filling the gap with a guess.

This applies equally to everything the app derives from a forecast: clothing suggestions, activity windows, travel timing, packing lists, and any notification we send. These are suggestions based on an estimate. They are not advice, and they are not a substitute for looking out of the window.

4 · Age

The service is for people aged 13 and over.

We do not ask your age and we have no way to check it. If you believe someone below that age is using the app, contact us at support@climaweather.com.

5 · Using the service fairly

You may use Climaweather for your own personal, non-commercial use.

Please do not: copy, scrape or systematically extract data from the app or our servers · attempt to access anyone else's data · probe, overload or interfere with our backend or its security measures · reverse engineer, decompile or disassemble the app, except where the law specifically allows it · use automated tools to access our servers · use the service to break the law.

If the service is being attacked or overloaded we will take steps to protect it, which may include limiting or blocking traffic.

6 · Your content and ours

Your answers, trips and settings are yours. You can export or delete them at any time from Profile → Privacy & data.

The app, its design, its code and the Climaweather wordmark, the subject of UK trade mark application UK00004388464 in classes 9 and 42, belong to us or to our licensors. These terms give you a personal, non-transferable licence to use the app on Apple-branded products you own or control, or on other devices you own or control. The licence ends when these terms end: see section 10.

Weather data belongs to its providers and is licensed to us, not to you. Map data and place information come from Mapbox and its data sources.

7 · Third-party services

The app relies on services from other companies, including weather data and maps. We are not responsible for the content those companies supply, and your use of the app is subject to their terms where those apply. This does not displace our own responsibility for the service we provide to you.

Places shown on the map come from third-party data. We do not check that a place is open or that it is suitable for you.

Weather data is powered by Vaisala Xweather (xweather.com). Forecast and observation data for Australia is supplied under licence from the Australian Bureau of Meteorology, and for Canada from Environment Canada.

8 · Notifications

If you allow notifications, the app can show you weather alerts and briefings; they are put together on your phone. You can turn them off altogether, or choose which kinds you want, in Profile → Notifications.

If you turn notifications off in your device settings, your choices here are kept: switch the permission back on and they are as you left them.

9 · What we promise, and what we do not

We work hard to keep Climaweather accurate and available, but:

Nothing in these terms limits or excludes our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit or exclude. If any part of these terms tries to do that, it does not apply.

Beyond that: we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable: meaning something that was not obvious at the time and that neither of us could have anticipated.

Where we are responsible, our total liability to you is limited to the greater of £100 or the amount you have paid us.

Climaweather is a free consumer app. We do not provide it for business use and we are not responsible for business losses: lost profit, lost revenue, lost business or business interruption.

You always have your legal rights as a consumer, and these terms do not affect them. In the UK you can find out more from Citizens Advice or your local Trading Standards office.

10 · Ending things

You can stop at any time by deleting the app. If you want your data removed from our servers first, use Profile → Privacy & data → Delete all my data before you uninstall.

If we discontinue the service we will give at least 30 days' notice in the app, unless we are required to stop sooner or the service is being withdrawn for safety or legal reasons. Your statutory rights are unaffected.

11 · Apple: this section applies only if you downloaded the app from the App Store

Apple requires us to include the following. You acknowledge that:

12 · General

Severability. If any part of these terms is found unenforceable, the rest continues to apply.

Entire agreement. These terms are the whole agreement between us about the service. This does not affect your statutory rights, and nothing in this section limits our responsibility for anything we have told you that turns out to be untrue, whether said carelessly or not.

Assignment. You may not transfer your rights under these terms. We may transfer ours to a company that takes over the service, provided your rights are not reduced.

No waiver. If we do not enforce a right, that is not a waiver of it.

13 · Governing law

You can bring proceedings in the courts of the part of the UK where you live, and the law of that part may apply to you. Otherwise these terms are governed by the law of England and Wales. If the consumer law of the country you live in gives you mandatory rights, protections or venues these terms cannot override, those apply to you regardless of this section.

14 · Changes

Every version of these terms is dated and numbered at the top of this page. If a change is material we will tell you in the app before it takes effect. We will not make a change that applies retrospectively.
